The parties agree to make a good-faith effort to resolve the dispute informally before commencing litigation, unless immediate legal action is reasonably necessary to protect intellectual property rights, confidential information, or other rights or to seek emergency injunctive relief. ### Court Proceedings If the parties are unable to resolve the dispute informally, any dispute that is not otherwise required by law to be resolved through another procedure may be brought in the state or federal courts located in **Orange County, California**, subject to the governing-law and jurisdiction provisions above. ### Small Claims Nothing in these Legal Terms prevents either party from bringing an eligible individual claim in small claims court when permitted by applicable law and the rules of the applicable court. ### No Class Actions To the fullest extent permitted by applicable law, any dispute between you and Prestige Writing Consulting shall be brought only on an individual basis and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action. Nothing in this provision limits any right that cannot lawfully be waived. ## 12. CORRECTIONS There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and other information. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT OR THE CONTENT OF ANY THIRD-PARTY WEBSITES LINKED TO THE SERVICES. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, BE AVAILABLE AT ANY PARTICULAR TIME, OPERATE WITHOUT INTERRUPTION OR ERROR, OR BE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT GUARANTEE ANY PARTICULAR RESULT FROM YOUR USE OF OUR SERVICES, INCLUDING ANY PARTICULAR EDUCATIONAL, WRITING, ADMISSIONS, APPLICATION, OR OTHER OUTCOME. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM LIABILITY FOR ANY ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; ANY INTERRUPTION OR CESSATION of transmission to or from the Services; unauthorized access to our systems; or any loss or damage resulting from your use of the Services or Content. LIMITATIONS OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL PRESTIGE WRITING CONSULTING OR ITS OWNER, EMPLOYEES, CONTRACTORS, AGENTS, OR SERVICE PROVIDERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE LEGAL TERMS WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO PRESTIGE WRITING CONSULTING FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT PAID ANY AMOUNT TO US FOR THE SERVICES GIVING RISE TO THE CLAIM, OUR TOTAL LIABILITY WILL NOT EXCEED $100. SOME STATE LAWS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF SUCH LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS. ## 15. INDEMNIFICATION To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Prestige Writing Consulting and its owner, employees, contractors, agents, affiliates, and service providers from and against any loss, damage, liability, claim, demand, or expense, including reasonable attorneys' fees, arising out of or relating to: 1. your use of the Services; 2. your breach of these Legal Terms; 3. your violation of applicable law; 4. your violation of the rights of a third party, including intellectual property or privacy rights; or 5. any content or Contribution submitted by you through the Services. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. ## 16. USER DATA We may maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as data relating to your use of the Services. Although we may perform routine backups, you are solely responsible for maintaining appropriate copies of any information or materials that you submit to or through the Services.
